Motion World – Terms & Conditions

Welcome to Motion World. We are excited to work with you and committed to building a strong, long-term partnership based on trust, clarity, and creativity. By using our services, you agree to the following Terms & Conditions:

1. Definitions

  • “We”, “Us”, “Our” refer to Motion World.

  • “You”, “Client” refer to the individual or entity commissioning work from Motion World.

  • “Work” refers to any creative output delivered, including animations, designs, videos, storyboards, or any associated materials.

2. Fees and Payment

  • All fees are outlined in our official quote.

  • Fees include the works described but exclude any third-party supplier costs unless specified.

  • A deposit is payable before project commencement. The balance is due upon final project completion and prior to release of deliverables.

  • Payments must be made within seven (7) days of the invoice date unless otherwise agreed.

  • All prices are exclusive of any applicable taxes.

3. Project Scope, Changes, and Revisions

  • Any changes to the original brief or requests for additional work will require a new quote and may incur additional fees.

  • Three (3) rounds of reasonable revisions are included unless stated otherwise.

  • Further revisions or changes outside the original project scope will be charged separately.

  • Clients are responsible for providing timely, consolidated feedback after each delivery stage to avoid unnecessary delays.

4. Confidentiality (NDA)

  • Both parties agree to keep all project-related information confidential.

  • We will not disclose any confidential or proprietary information shared during the project without your prior written consent.

  • Likewise, you agree to keep confidential any non-public information about Motion World, its processes, or its business practices.

  • This obligation of confidentiality remains effective even after project completion.

5. Copyright & Intellectual Property

  • Motion World retains ownership of all original materials, drafts, concepts, and project files unless otherwise agreed in writing.

  • Upon full payment, the client is granted a non-exclusive, worldwide, perpetual licence to use the final deliverables for the agreed purpose.

  • Usage outside the originally agreed scope may require additional licensing fees.

  • Unused concepts, proposals, or designs remain the intellectual property of Motion World and may not be used without written permission.

  • You warrant that all materials you provide (e.g., logos, scripts, images) are properly licensed, and you indemnify us against any third-party claims relating to these materials.

6. Project Duration and Delivery

  • The project timeline, including key milestones, will be detailed in the project scope document.

  • Timely feedback, approvals, and provision of materials are essential to meet deadlines.

  • Any client-side delays may result in adjusted timelines and additional charges.

  • Upon final delivery, formal written sign-off is required to close the project.

7. Quality Assurance and Acceptance

  • We take pride in delivering high-quality work.

  • Any issues must be raised in writing within seven (7) days of receiving the final deliverables.

  • If no issues are raised within this period, the work will be deemed accepted.

8. Termination and Cancellation

  • Either party may terminate the project at any time with written notice.

  • If Motion World terminates, any unused, prepaid work will be refunded.

  • If the client terminates:

    • After a stage’s completion: all fees up to that stage are payable.

    • During an ongoing stage: the full fee for that stage is payable.

  • Any third-party costs already incurred are also payable by the client.

9. Promotion and Portfolio Rights

  • Unless agreed otherwise, Motion World reserves the right to showcase completed work in our portfolio, website, showreels, and social media channels.

  • We respect confidentiality agreements where required.

10. Governing Law

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.

  • Any disputes will be subject to the exclusive jurisdiction of the English courts.

11. Updates to Terms

  • Motion World may update these Terms & Conditions periodically.

  • Changes will be published on our website, and continued use of our services indicates acceptance of the updated Terms.
